This store is operated by 5AMDREAMS LLC, a Wyoming limited liability company trading as NENALI (“we”, “us”). These terms govern your use of the site and any purchase you make from it. By browsing the site or placing an order you accept them. If you do not accept them, please do not use the site.

2. Access and accounts

You must be at least 18, or the age of majority where you live, to buy from this store. If you create an account you are responsible for what happens under it and for keeping your details current. We may suspend or close an account used for fraud, resale or abuse of our policies.

3. Our products

NENALI products are cosmetics, not medicines. They are not intended to diagnose, treat, cure or prevent any disease, and nothing on this site is medical advice. Results vary between individuals. Read the ingredient list before use, stop using the product if irritation occurs, and speak to a healthcare professional if you have a skin condition or a known allergy.

We describe our products as accurately as we can. Colours and textures can look different on different screens, and natural ingredients vary slightly between batches.

4. Orders

Your order is an offer to buy. A contract is formed when we send the dispatch confirmation. We may decline or cancel an order — for example where a product is unavailable, where a price is clearly wrong, or where we suspect fraud — and we refund you in full if we do.

We may limit quantities per customer, per household or per order.

5. Prices and billing

Prices are shown in the currency selected at checkout and may change without notice, though a change never affects an order already placed. Payment is taken at checkout through our payment processors; we do not store your card details.

You are responsible for giving current, complete and accurate billing information, and for keeping it up to date.

6. Subscriptions and automatic renewal

Where you choose a recurring plan, you authorise us to charge your payment method at the interval, quantity and price shown at checkout, until you cancel. The cadence is shown clearly before you pay.

By placing the first order you accept the auto-renewal offer and understand that it continues until you pause or cancel it. Managing, pausing and cancelling your plan is your responsibility, and we make it easy: you can do it from your account or by replying to any email from us, without phoning anyone. We also email you before every renewal charge, with a one-click option to skip that shipment.

To avoid a charge, cancel before the next renewal date. If you contacted us before the renewal date but the charge went through first, tell us — we look at the time of your message and put it right.

7. Shipping, returns and refunds

Our shipping policy and refund policy form part of these terms.

8. Emails and text messages

If you give us your email address or mobile number we may send you order updates and, where you opted in, marketing messages. You can unsubscribe from marketing at any time using the link in any email or by replying STOP to a text. Message and data rates may apply. Order and delivery messages are part of the service and are not marketing.

9. Intellectual property

The NENALI name, logo, photography, text and page designs belong to us or to our licensors. You may not copy, republish or use them commercially without our written permission. Product reviews and photos sent to us may be used on the site and in our marketing, with the first name and initial only.

10. Third-party tools and links

The site uses third-party tools and may link to third-party sites. We provide them as they are, we do not control them, and we are not responsible for their content or their policies. Read theirs before you use them.

11. Relationship with Shopify

This store runs on Shopify, which provides the online platform, hosting and payment infrastructure. Shopify processes personal data on our behalf as described in our privacy policy.

12. Privacy

Our privacy policy explains what personal data we collect and what we do with it. It forms part of these terms.

13. Things you may not do

Do not use this site for an unlawful purpose, to break any law, to infringe our rights or anyone else's, to harass or abuse anyone, to upload viruses or malicious code, to collect other people's personal data, to scrape the site, or to interfere with its security. We may end your access for any of these.

14. Disclaimer

The site is provided as it is. We do not promise that it will be uninterrupted, error-free, or that every result you read about will be your result. Nothing in these terms excludes any liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Where you are a consumer, your statutory rights are unaffected by anything in these terms.

15. Limitation of liability

To the extent the law allows, our total liability in connection with an order is limited to the amount you paid for it. We are not liable for indirect or consequential loss. Again, this does not affect the statutory rights of consumers, or any liability that cannot lawfully be limited.

16. Indemnity

You agree to hold us harmless from claims arising out of your breach of these terms or of any law.

17. Disputes

If something goes wrong, email support@nenali.com first. Almost everything is settled that way within a day.

If it is not, any dispute that cannot be resolved informally will be settled by binding individual arbitration in the State of Wyoming, under the rules of the American Arbitration Association, rather than in court, and not as part of a class or representative action.

This arbitration clause does not apply if you are a consumer resident in the United Kingdom, the European Union, or any other place whose law gives you the right to bring a claim in your local courts. There, you keep that right and you may also use your national online dispute resolution service.

18. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Where you are a consumer elsewhere, you also keep the protection of the mandatory consumer law of the country where you live.

19. Severability and waiver

If any part of these terms is found unenforceable, the rest stays in force. If we do not enforce a right straight away, we do not lose it.

20. Changes to these terms

We may update these terms. The version that applies to your order is the one published on the day you ordered. The date at the top shows when this version was published.
